Protecting a brand in Mexico requires a strategy adapted to the local market, the rights already in place and the products or services your business intends to offer. Ramírez Esteves advises international businesses, brand owners and foreign counsel on trademark protection in Mexico, with a practice based in Guadalajara and a national scope.
We help you assess the legal position of your brand, plan its protection and address challenges that arise during registration or commercial use. Our work connects trademark rights with the business decisions behind market entry, licensing, investment and portfolio management.
Trademark services for your business in Mexico
- Trademark availability searches and assessment of potentially conflicting rights.
- Filing strategy and preparation of applications before the Mexican Institute of Industrial Property (IMPI).
- Review of the goods and services to be covered and the appropriate scope of protection.
- Responses to examination issues and representation in trademark oppositions.
- Advice on licensing, ownership and the legal documentation of trademark portfolios.
- Coordination with our litigation practice when a registration dispute or infringement requires further action.
For international companies and foreign counsel
If your company is entering Mexico or your client needs local trademark support, the starting point is a clear description of the brand, its ownership and its intended use. Existing registrations abroad can be relevant to the filing strategy, but protection in another jurisdiction should not be treated as automatic protection in Mexico.
We can review the Mexican aspects of a portfolio and coordinate the information needed for local representation. The scope of each engagement, responsibilities, fees and required documentation are agreed before work begins.
How we approach a trademark project
- Understand the business. Identify the owner, the relevant products or services, the target market and the commercial objective.
- Assess the legal position. Review existing rights, relevant documentation and potential conflicts.
- Define the protection strategy. Agree on the filing approach and the work needed to address foreseeable issues.
- Manage the matter. Prepare the agreed filings and review developments that may require a response or a change in strategy.
Information for an initial enquiry
Share the proposed trademark or logo, the owner’s name, a description of the products or services, any existing foreign applications or registrations, and your intended timing for entering Mexico. If there is a pending deadline or a communication from IMPI, mention it in your enquiry. We will specify the documents required for the particular matter.
Frequently asked questions
Does a foreign registration protect my trademark in Mexico?
Trademark protection is territorial. A foreign registration alone does not replace the assessment of the rights and protection available in Mexico. An international registration designating Mexico may be relevant; its scope of protection remains subject to the applicable Mexican framework.
Can you assist a company outside Mexico?
Yes. Our practice advises domestic and international companies on intellectual property matters in Mexico. Your initial enquiry can be made in English and can identify the foreign counsel coordinating the matter.
Can you guarantee registration or a fixed completion date?
The outcome and timing depend on the application, existing rights, examination and any dispute. We assess the particular matter and explain the proposed work before accepting the engagement.
What if a trademark issue becomes a dispute?
Our intellectual property litigation practice in Mexico can assess oppositions, invalidity, cancellation and infringement matters within an agreed engagement.
